1. Our Commitment

Diamantwerp has been selling certified natural diamonds from the Antwerp Diamond District since 1987. We stand behind every stone we sell. Where our return policy applies, we offer a 30-day return window — double the EU-mandated 14-day statutory cooling-off period — because we want you to buy with complete confidence.

Every diamond we sell is independently certified by GIA, HRD Antwerp, or IGI. Each stone is a unique, individually identified product. This individual nature — and the way diamonds are priced and sourced on live international markets — means that certain orders are subject to legal exceptions to the right of withdrawal. We explain exactly when and why below, so there are no surprises.

2. When Does the Return Policy Apply?

Because each diamond is a unique, certified product sourced at live market prices, the applicability of our return policy depends on the specific circumstances of your order. There are three possible scenarios:

Scenario A — Full 30-Day Return Policy Applies

Our extended 30-day return policy applies where no legal exception is triggered — typically for diamonds held in Diamantwerp's own inventory at the time of order, where market-price fluctuation risk is carried by Diamantwerp rather than sourced live on your behalf. In this case, you may return the diamond within 30 days of delivery for a full refund, subject to the return conditions in Section 3.

Scenario B — Statutory 14-Day Right of Withdrawal Applies

Where the diamond in your order was held in stock and no individual sourcing exception applies, you retain the statutory EU 14-day right of withdrawal under Belgian law (Articles VI.47–VI.53 WER), regardless of any other exception. In practice, this means a minimum of 14 days always applies where the statutory right has not been lawfully excluded.

Scenario C — Return Policy Does Not Apply (Legal Exception)

Certain orders are exempt from the right of withdrawal and fall outside our return policy, in accordance with Article VI.53 of the Belgian Code of Economic Law. This applies when one or more of the following is true:

  • Market-linked pricing: The diamond was sourced at live Rapnet wholesale market prices at the time of your order. Diamond prices fluctuate daily based on international supply, demand, and currency movements — factors entirely outside Diamantwerp's control. (Art. VI.53, 2° WER)
  • Individually sourced on your request: The specific diamond — identified by its unique certificate number (GIA, HRD or IGI) — was procured from our wholesale network exclusively on your behalf. B2B wholesale transactions with our suppliers are final and cannot be reversed. (Art. VI.53, 3° WER)
  • Custom jewellery or bespoke setting: The diamond has been set in a ring, pendant, or other jewellery piece to your specifications (metal type, ring size, engraving, etc.), making it a personalised product.
  • Security seal broken: The original packaging and/or security seal was broken after delivery, preventing independent verification of the diamond's condition and identity.

3. Return Period & Conditions

These General Terms & Conditions apply to every offer, quotation, order, and agreement between Diamantwerp and the Customer, regardless of the channel through which the transaction is initiated (website, email, telephone, or in person), unless expressly agreed otherwise in a separate written agreement signed by both parties.

By placing an order, the Customer confirms that they have read, understood, and accepted these terms in full. These terms are made available to the Customer prior to the conclusion of any agreement and can be saved, printed, and reproduced at any time via our Website.

Any general terms or conditions of the Customer are hereby expressly excluded and shall not apply, even if they have not been explicitly rejected.

If any provision of these terms is held invalid or unenforceable by a competent court, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that achieves the same commercial purpose as closely as legally permissible.

In the event of a conflict between these General Terms & Conditions and any specific written agreement, the specific written agreement shall prevail, but only to the extent of the conflict.

4. How to Initiate a Return

To initiate a return, please follow these steps:

  1. Contact us in writing before the return period expires. Send an email to questions@diamantwerp.be with your order number, the certificate number of the diamond, and a brief explanation. We will confirm receipt within 2 working days.
  2. Await our return authorisation. Do not ship the diamond before receiving written confirmation from us. We will provide you with the return shipping address and any specific packaging instructions.
  3. Pack the diamond securely. Use the original packaging where possible. Ensure the diamond, certificate, and all documentation are included. Seal the package securely.
  4. Ship via insured, traceable courier. Declare the full value of the diamond for insurance purposes. Send us the tracking number immediately after dispatch.
  5. Await inspection and confirmation. Once we receive the diamond, our gemologist will inspect it within 5 working days. We will notify you of the outcome and process your refund accordingly.

5. Inspection & Assessment

Upon receipt of a returned diamond, our qualified gemologist conducts a thorough inspection to verify the following:

  • Identity: The returned diamond matches the certificate number and specifications of the original order.
  • Condition: The diamond shows no signs of damage, chipping, scratching, or alteration beyond what is strictly necessary to assess its characteristics.
  • Certificate integrity: The original certificate is present, unaltered, and matches the returned stone.
  • Packaging: The return was made in appropriate, secure packaging.

This inspection takes up to 5 working days from receipt. You will be notified of the result in writing.

Diminished Value

If the returned diamond shows signs of handling, damage, or wear beyond what is strictly necessary to assess its nature and characteristics, Diamantwerp reserves the right to make a proportionate deduction from the refund amount to reflect the diminished value, in accordance with Article VI.51 §3 of the Belgian Code of Economic Law. Any deduction will be communicated to you in writing before the refund is processed.

If the returned item does not meet the return conditions (wrong stone, missing certificate, damaged, or altered), Diamantwerp reserves the right to refuse the return and reship the diamond to the Customer at the Customer's cost.

6. Refund Process

Once the inspection is complete and the return is approved, Diamantwerp will process your refund as follows:

  • Refund amount: The full purchase price, including standard delivery costs paid at checkout. Supplementary delivery costs (e.g. express or premium shipping upgrades chosen by the Customer) are not refunded.
  • Return shipping costs: These are borne by the Customer and are not reimbursed, except in the case of a defective or incorrectly delivered item (see Section 9).
  • Payment method: Refunds are processed using the same payment method as the original transaction. No additional charges apply.
  • Processing time: Within 14 calendar days of approving the return, or within 14 calendar days of receiving proof of dispatch — whichever is earlier.

7. Exchanges

Would you prefer to exchange your diamond for a different stone rather than receive a refund? We are happy to help.

Contact our team at questions@diamantwerp.be within the applicable return window. We will guide you through our collection to find a diamond that is the perfect fit for you — whether you are looking for a different carat weight, cut, colour, or clarity grade.

  • Exchanges follow the same return conditions as a standard return (Section 3.2).
  • If the replacement diamond is of a higher value, we will invoice the price difference. If it is of a lower value, we will refund the difference via the original payment method.
  • The replacement diamond is subject to a new 30-day return window from its delivery date, where applicable under the same eligibility conditions.
  • Please note that the availability of a specific replacement diamond cannot be guaranteed, as each stone is unique and our inventory is live.

8. Non-Returnable Items

The following items are not eligible for return or refund, in accordance with Belgian consumer law and our General Terms & Conditions (Article 9):

  • Individually sourced diamonds: Diamonds specifically procured from our wholesale network on your request — identified by their unique certificate number — where this exception was communicated at checkout. Wholesale B2B sourcing on behalf of the Customer is irreversible.
  • Market-priced diamonds: Diamonds sourced at live Rapnet market prices, where price fluctuations during the return window cannot be absorbed. This exception is always disclosed before purchase.
  • Custom jewellery & bespoke settings: Any diamond that has been set into a ring, pendant, bracelet, or other jewellery piece to your specifications — including metal type, ring size, engraving, or any other personalisation.
  • Broken security seal: Diamonds returned without their original intact security seal or packaging, where this prevents independent verification of the stone's identity and condition.
  • Missing certificate: Diamonds returned without the original, unaltered gemological certificate (GIA, HRD Antwerp, or IGI).
  • Returns outside the window: Returns initiated after the applicable 30-day (or 14-day statutory) return period has expired.

9. Defective Items & Incorrect Deliveries

Defective or Non-Conforming Diamond

In the unlikely event that the diamond you receive has a defect that was not disclosed in the grading certificate, or does not conform to the specifications confirmed in your order, please contact us immediately at questions@diamantwerp.be.

In such cases:

  • We will arrange and cover the cost of a free insured return shipment.
  • You will have the choice between a replacement diamond of equivalent specifications or a full refund including all original shipping costs.
  • A non-conformity claim is always assessed with reference to the original grading certificate — this is the definitive specification document for every diamond we sell.

Under EU and Belgian law, you are entitled to a two-year legal guarantee of conformity on all products purchased from Diamantwerp, regardless of whether the standard return policy applies or not. See Article 10 of our General Terms & Conditions for full details.

Incorrect Delivery

If you receive a diamond that does not match your order — wrong carat, colour, clarity, cut, or shape — please contact us within 48 hours of delivery by email with your order number, the certificate number received, and photos of the package and stone. We will resolve the situation at no cost to you.

10. Your EU Consumer Rights

This Return Policy is a commercial policy provided by Diamantwerp in addition to your statutory rights under Belgian and EU law. Nothing in this policy limits or excludes any right you have as a Consumer under applicable legislation, including:

  • Right of withdrawal: The statutory 14-day cooling-off period under Articles VI.47–VI.53 of the Belgian Code of Economic Law and EU Directive 2011/83/EU, where no legal exception applies.
  • Legal guarantee of conformity: A two-year guarantee that the product conforms to what was agreed, under Articles 1649bis–1649octies of the Belgian Civil Code and EU Directive 2019/771.
  • Remedies for non-conformity: The right to repair, replacement, price reduction, or contract termination where a product does not conform to the agreement.
